1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Webby BioLinks service operated by Webby Link (Reg. No. 002190850-M) at biolinks.webbypage.com ("we", "us", "our", "the Service"). By registering for, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. About the Service

Webby BioLinks provides a platform for creating and managing link-in-bio pages, short links, QR codes and related tools ("the Service"). We may modify, suspend or discontinue any part of the Service at any time.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using the Service you represent that the information you provide is accurate and complete.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.

5. Subscriptions, Fees and Payment

Some features of the Service are provided under paid plans. Fees, billing cycles and features are as displayed on the Service and in your account plan. You authorise us to charge the payment method you provide. Unless otherwise stated, fees are non-refundable, subject to applicable law. We may change pricing with reasonable notice through the Service.

6. Licence to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own lawful purposes. You may not resell, sublicense, or commercially exploit the Service without our written consent.

7. Acceptable Use and Prohibited Activities

You agree not to misuse the Service. Prohibited activities include, without limitation:

• Creating or distributing content that is unlawful, defamatory, obscene, or infringes the rights of others;
• Using the Service for phishing, fraud, malware, spam, or other malicious purposes;
• Harassing, threatening or harming others;
• Interfering with, disrupting or overloading the Service, its servers or networks;
• Attempting to gain unauthorised access to accounts, systems or data;
• Scraping, crawling or otherwise harvesting data from the Service without authorisation;
• Impersonating any person or entity or misrepresenting your affiliation; and
• Violating any applicable law, regulation or the rights of any third party.

We may remove content and suspend or terminate accounts that breach these provisions.

8. User Content

You retain ownership of the content you submit, post or store through the Service. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store and display your content solely to provide the Service to you. You represent that you have the necessary rights to the content you provide and that it complies with these Terms.

9. Third-Party Links and Embedded Content

The Service may contain links to third-party websites and allow integration with third-party services. We do not control and are not responsible for the content, products, policies or practices of third parties. Your use of third-party services is at your own risk and subject to their own terms and policies.

10. Intellectual Property

The Service, including its software, design, logos, trademarks and content (other than your user content), is owned by Webby Link or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from it without permission.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Webby Link and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or business opportunities, arising from or in connection with your use of the Service. Our total aggregate liability arising from or related to these Terms shall not exceed the amount you paid us during the 12 months preceding the event giving rise to the liability.

13. Indemnity

You agree to indemnify and hold harmless Webby Link, its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including legal fees) arising out of or in connection with your use of the Service, your user content, or your breach of these Terms.

14. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if required by law. You may stop using the Service and delete your account at any time. Clauses that by their nature should survive termination (including Sections 10 to 13 and 16) will remain in effect.

15. Data Protection

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. Please review it carefully.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

17. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
